Why do many claim cuttings are illegal?

The court clarified: As soon as a cutting is planted (e.g., in soil or rock wool) and begins to root, it is no longer legally considered a cutting, but a cannabis plant. Since the commercial trade of cannabis plants in Germany is strictly prohibited, the sale of potted young plants is classified as illegal trade.
What exactly does the law (KCanG) say?
To understand the situation, one must know the definitions in the law:
- Cuttings = Propagation Material: According to § 1 No. 6 KCanG, cuttings are "young plants or shoot parts of cannabis plants that are intended for cultivation and have no flowers or fruiting bodies."
- Possession: As a private person, you are theoretically allowed to possess an unlimited number of cuttings, as they do not count as "cannabis" within the meaning of the 50g quantity limit. Only when they become actual "plants" does your 3-plant rule apply.
- Transfer: The law stipulates that essentially only cultivation associations (Cannabis Clubs) may hand over cuttings to members (and to a limited extent to non-members). A commercial online shop with profit motive is on extremely thin ice here.
The Role of the BGH (November 2024)
The Federal Court of Justice (BGH) also indicated at the end of 2024 that "potted seedlings" could already fall under the definition of cannabis. This means: Anyone commercially trading in rooted plants risks criminal proceedings for unauthorized distribution of cannabis.
