The new Cannabis Act (CanG)

Since April 1, 2024, a new wind has been blowing in Germany. The new Cannabis Act (KCanG) has paved the way for legal and responsible handling of cannabis for adults. But what exactly is allowed and where are the limits? We have summarized the most important points for you in a compact form, so that you can enjoy your grow legally.

1. Possession and Consumption: The Facts

Are you at least 18 years old? Then you can legally possess cannabis in Germany. The quantities are clearly defined:

  • On the go: Up to 25 grams of dried cannabis is not punishable.
  • At home: You may store up to 50 grams of dried cannabis in your home.

2. Your Own Garden: 3 Plants are Law

The core for all growers: You may cultivate up to three flowering cannabis plants simultaneously. The following applies:

  • The plants must be protected from access by children and adolescents (e.g., lockable grow tent or room).
  • Neighbors must not be unreasonably bothered by odors (tip: use activated carbon filters!).

3. Cannabis Social Clubs (CSC)

Those who do not want to grow themselves can become a member of a cultivation association. These clubs may collectively cultivate cannabis and distribute it to their members. Distribution limits apply of a maximum of 50 grams per month (for under 21s a maximum of 30 grams with reduced THC content).

4. Where is consumption allowed?

Freedom also means consideration. Public consumption is prohibited:

  • Within sight of schools, playgrounds, daycares, and youth facilities (at least 100 meters distance).
  • In pedestrian zones between 7:00 AM and 8:00 PM.
  • In the immediate vicinity of minors.

5. Cannabis in Road Traffic

Safety first! A THC limit of 3.5 ng/ml blood serum has been set for drivers. Those who exceed this value risk high fines and driving bans. Especially for novice drivers during their probationary period, the following still applies: Absolute cannabis ban!
