Return Policy and Right of Withdrawal for MischSeeds

At MischSeeds, we are dedicated to ensuring you are completely satisfied with your purchase. Should you unexpectedly be unsatisfied or change your mind, we offer a transparent return policy and right of withdrawal to make the process as straightforward as possible.

Consumer Right of Withdrawal

Cannabis seeds can be returned, BUT only if they are factory sealed. Once the packaging has been opened, the value is lost.

Reasons for Exclusion or Premature Expiry of the Right of Withdrawal: The right of withdrawal expires prematurely in the case of contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal was removed after delivery. This applies in particular to plant seeds whose original packaging has been opened, as improper storage by the consumer can impair germination capacity.

Defect Claims & Product Liability

Our role is to facilitate the transaction between breeder and customer. The seeds remain in their original, tamper-evident breeder packaging that has neither been opened nor damaged. MischSeeds is therefore not liable for seed replacement in cases of germination or quality issues.

If you experience any issues with your seeds, please contact the breeder directly. We will gladly assist you in facilitating communication to resolve the matter—including direct seed replacement by the breeder. However, this remains at the breeder's sole discretion, not MischSeeds'.

We cannot accept complaints for orders placed more than 30 days after purchase, as we have no control over how seeds have been stored during that time.

You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, other than the carrier, takes possession of the goods.

To exercise your right of withdrawal, you must notify us (MischSeeds, In den Gärten 2, 51766 Engelskirchen, Germany, [email protected]) by means of a clear statement (e.g. an email) of your decision to withdraw from the contract. You may use the attached model withdrawal form, but it is not obligatory.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of supplementary costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we receive notice of your withdrawal. We will process this refund using the same payment method you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

Return Shipping Costs

You bear the direct cost of returning the goods.

Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to contracts for the delivery of goods that are liable to deteriorate rapidly or where the expiration date would be quickly exceeded.
