These General Terms and Conditions (hereinafter "GTC") apply to all orders and deliveries made via the website MischSeeds (hereinafter "Website"). By using the Website and completing an order, you agree to these GTC.

3. Order Process and Conclusion of Contract

By submitting an order on our Website, you submit a binding offer to purchase the selected products. The contract is concluded as soon as we confirm your order by sending an order confirmation email. The presentation of products in our online store does not constitute a legally binding offer, but rather a non-binding online catalog.

4. Prices and Payment

Prices stated on the Website are in Euros and include applicable statutory VAT. Shipping costs are listed separately. Customers have access to the payment methods offered during the checkout process (e.g., advance payment / bank transfer, credit card). We reserve the right to exclude individual payment methods in specific cases.

5. Delivery and Shipping

Delivery takes place within the timeframes specified during the ordering process (typically 2–5 business days from receipt of payment). We ship discreetly and securely from our logistics hub. Please note that delivery delays may occur due to force majeure or unforeseen circumstances.

6. Right of Withdrawal and Returns

Consumers possess a statutory 14-day right of withdrawal. The detailed terms and instructions for returns can be found in our separate Cancellation and Return Policy on the Website.

7. Warranty and Nature of Goods (Natural Products)

(1) The cannabis seeds offered are natural agricultural products. The characteristics and developmental viability of seeds depend on numerous external variables (e.g., temperature, humidity, light, grow medium) over which we have no influence. (2) We guarantee the freshness and proper storage of the seeds up until the transfer of risk (dispatch). Expressly, no guarantee is provided for germination or specific yields. Stated values (e.g., THC content, terpene profiles, yield capacity) are manufacturer guidelines representing ideal benchmarks under optimal conditions. (3) Seeds are sold primarily as collectible items or souvenirs. The customer is solely responsible for staying informed about and complying with all applicable laws and regulations in their jurisdiction.

8. Defect Claims & Product Liability

Our role is to facilitate the transaction between breeder and customer. The seeds remain in their original, tamper-evident breeder packaging that has neither been opened nor damaged. MischSeeds is therefore not liable for seed replacement in cases of germination or quality issues.

If you experience any issues with your seeds, please contact the breeder directly. We will gladly assist you in facilitating communication to resolve the matter—including direct seed replacement by the breeder. However, this remains at the breeder's sole discretion, not MischSeeds'.

We cannot accept complaints for orders placed more than 30 days after purchase, as we have no control over how seeds have been stored during that time.

9. Data Protection

Your personal data is handled and protected in accordance with our Privacy Policy. We use your data exclusively for processing your order and fulfilling mandatory statutory documentation requirements.

10. Amendments to the Terms and Conditions

We reserve the right to amend these GTC as necessary to accommodate legal or operational adjustments. The currently applicable version is always accessible on our Website.

11. Applicable Law and Jurisdiction

These GTC are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction for all disputes arising from or in connection with these GTC and orders is Gummersbach, Germany, provided the customer is a merchant or has no general place of jurisdiction in Germany.
